Parking Lot Rules
I. Rental Agreement
By entering the parking lot, a rental agreement for the use of a parking space for a motor vehicle (vehicle) is concluded. Neither supervision nor safekeeping is part of this agreement.
II. Rental Fee & Parking Duration
The rental fee is determined for each occupied parking space according to the displayed price list. The vehicle may only be collected during the stated opening hours. The maximum parking duration is two days unless a special agreement has been made. After the maximum parking duration, the operator is entitled to remove the vehicle at the tenant’s expense. In addition, the operator is entitled to a fee corresponding to the rental price until the vehicle is removed. In the event of a lost parking token, the daily rental fee is payable unless the tenant can prove a shorter parking duration or the operator approves a longer one.
III. Operator Liability
The operator is liable for all damages caused by themselves, their employees, or agents. The tenant must report such damage immediately and in any case before leaving the parking lot. The operator is not liable for damages or theft of the parked vehicle or items inside the vehicle caused by third parties.
IV. Tenant Liability
The tenant is liable for all damages caused by themselves, their employees, agents, or accompanying persons to the operator or third parties. Furthermore, the tenant is liable for any damages or pollution of the parking lot caused intentionally or negligently.
V. Right of Retention / Lien
The operator has a right of retention and a statutory lien on the tenant’s parked vehicle for claims arising from the rental agreement. If the tenant is in default of payment, the operator may exercise the lien no earlier than two weeks after notifying the tenant.
VI. Parking Lot Usage Rules
The tenant must observe traffic signs and other usage regulations and follow instructions from parking lot staff. Otherwise, the provisions of the road traffic regulations apply. The tenant must exercise due care throughout the parking area, even when assisted by parking personnel. Driving is allowed only at walking speed (maximum 10 km/h). After parking, the tenant must properly lock and secure the vehicle. The operator is entitled to remove the vehicle in case of urgent danger. Any commercial activity in the parking lot (e.g., distributing advertising material or selling goods) requires prior written approval from the operator. The above provisions also apply to the free provision of parking spaces.
