PARKING REGULATIONS

I. Lease agreement
When a guest drives into the car park, a lease agreement for the use of a parking space for a motor vehicle is concluded. Neither the supervision nor the safekeeping of the vehicle are covered by this agreement.

II. Lease price - Parking period
The lease price for each occupied parking space shall be calculated in accordance with the price list provided. The vehicle may only be collected during the specified opening hours. The maximum stay is two days, unless a special arrangement has been agreed upon. After the maximum stay has expired, the Lessor is entitled to remove the vehicle at the expense of the Lessee. In addition, the Lessor is entitled to a fee corresponding with the lease price list until the vehicle is removed. In the event that the Lessee loses their parking token, the Lessee shall pay the lease price for one day, unless the Lessee presents evidence of a shorter stay or the Lessor presents evidence of a longer stay.

III. Liability of the Lessor
The Lessor is liable for all damage caused by themselves, their employees or their agents. The Lessee is obliged to report any such damage immediately and in any case before leaving the car park. The Lessor is not liable for damage to or theft of the parked vehicle or the items stored inside the vehicle caused by third parties.

IV. Liability of the Lessee
The Lessee is liable for all damage to the Lessor or to third parties which is culpably caused by themselves, their employees, their agents or persons accompanying them. The Lessor is also liable for any culpably caused soiling of the car park.

V. Lien
The Lessor is entitled to a right of retention and a statutory right of lien with respect to the Lessee’s parked vehicle on account of the Lessor’s claims arising from the lease agreement. If the Lessee is in default with regard to the settlement of the Lessor’s claims, the Lessor shall be entitled to undertake debt recovery action at the earliest 2 weeks after giving prior warning.

VI. Terms and conditions for use of the car park
The Lessee is required to observe the road signs and other terms and conditions of use and to follow the instructions of the car park staff. Otherwise, the provisions of the German Road Traffic Regulations (StVO) shall apply accordingly. The Lessee shall exercise due diligence throughout the car park area, including when assisted by car park staff with instructions. In the car park, the Lessee may only drive at walking speed (max. 10 km/h). After parking the vehicle, the Lessee is obliged to lock the vehicle properly and to secure it with due diligence. The Lessor is entitled to remove the vehicle from the car park in the event of urgent danger. Any commercial activity in the car park (e.g. distribution of advertising material or sale of goods) requires the prior written approval of the Lessor. The above provisions shall apply mutatis mutandis in the event of a free transfer of parking spaces.
